Well no, it is based on Calvin, it's just not a legal portrayal of him. I'm not sure how they get away with it. I'm supposing it may be because they're made under the guise of custom stickers, the producers of which, often make and sell them at kiosks in malls. Because they don't have any stocked in inventory, and all stickers are made by special request, they can get away with making just about anything. Just like my Phantasy Star Zippo Lighter, and Skyly ID Zippo Tape Measure, that I have in my pocket at all times. The materials engraved on them are properties of Sonic Team at this moment, but a custom engraver in a kiosk at a local mall was more than happy to put them on these products. Just the same, you could take a picture of Meira and put her on a t-shirt, and legally speaking, there wouldn't be much I could do about it, because it was your right as an individual to take an image and have it put on a product of your choice.
Now, if you were to have a number of those t-shirts made and sell them, THEN there would be legal grounds to consider, or if the t-shirt was slanderous, then there'd be a legal issue to consider there as well, but otherwise, there'd be no legal issue.
So, simply enough, they can sell Calvin stickers because the product is a "Custom Sticker" and is not marketted as a "Calvin and Hobbes Sticker".
