Microsoft don't own the servers so they can't ban you from them, if it was a Microsoft issue then I assume he wouldn't even be able to log in to his gamertag or any online game

The warps do make noise, although I've had times when I couldn't hear anything stood right on top of it, I had to move off of the warp slightly
