not quite, they are in some aspects but that is not enouph to say they are illegal.

aleronives from a priate server
It's illegal because:

He copied Sega's server functions by looking at the way Sega's server handled server/client interaction.
He directly copied data from their server such as the quests and uses that data on his server.

It isn't illegal because:

He never stole any of Sega's source code, the server program was written entirely by him not by hacking into Sega's mainframe and taking the server executable from them.
The data he used was flowing freely over his network as it always does when you play PSO, he just chose to log and use that data which most players don't do. Every time you load a quest it gets downloaded to your DC, GC, or PC, he just saved it. Since it was flowing over his network, it could be said that it was not stolen. (This is basically the same reasoning Lee used when he copied our quests and put them on his server.)
The server contains an agreement when you log on that if you're affiliated with Sega you cannot use/log data from the server, so if they broke that agreement to log evidence against *name* it would be invalid in court.

EDIT: Name removed.

Hey you may want to remove the server name in your post, DC Player. That could easily lead people there, which PSOworld will not tollerate.

To the original poster, there is no need to bump your topic twice when it's at the top of the page already, particularly within four minutes of eachother. Somebody will answer your question in time. You just need patience.

actually, to host a private server for a comercal game that has/had online servers isa crime. read copyright information if you want proof. private servers, weither copyed or writen them selves is illegal in that you are infringing apon a copyrighted product or idea. sorry guys, but no matter what, there are no LEGAL private servers.
