But Nintendo already lost that fight and the appeal.

It's under the user agreement on the hunters license that you won't use cheat devices while on Sega's servers. They can't do anything to stop you while you're off it.

But the NES didn't have any online games for people to ruin.

I don't see how this effects anything. There's no legal basis for such a lawsuit. They already say you can't use it while connected, that's about all they can do.

It's ok to sell these things if no gaming system could go online, but there might be basis for an argument if a cheating device was able to go online. If people have the ability to ruin an online game for others, people will have ended up paying for a product that makes children cry, or something like that.

Most online games prohibit cheating in any form and if you are caught you are punished. Pay to play MMORPGs like Everquest have a ardent anti cheating measures and punish people for cheating. However, Sonic Team didn't include a "no duping items" clause in their ToS cause it isn't their game and it isn't their system. You have to play by their while on their server but how can they know that you have a duped item or a legit one? How can they know if you changed the stats on your character while you were offline? There's no way that they can. The service you pay for is to get on their servers and play their game the way they want you to play it while you're there.

What you do on your own system on your own time is well within your bounds and they don't have any legal recourse.

Well, yeah, but most people will take it online. Cheating and potentially ruining other people's games is morally wrong. Just on the basis of morality we might have a case! Woo!

    BWAHAHAHAHAHAHAHAHA

Dupers don't usually cheat just to grief other people, they cheat cause they lack the patience to find stuff like they're supposed to. First off, theres no malicious intent, second, you still can't tell if someone is cheating or not.

Sure they don't intentionally do it to hurt others but that's usually an indirect effect of the cheating devices being available.

Also, watcher Rappies are tracking your motions CHEATERS. Watch out. The next one that pecks you will plant a tracking device on your butt! Then we can watch you run all over the map and lobbies! HaHAHAhaha!

No, but really, even if people use the device for their own enjoyment, which is perfectly ok in an offline environment, this still doesn't mean that they won't be restricted from coming online and spreading duped or hacked items. I know many people feel badly about this, so I would consider that ruining others' experience even if they trade the items without the intention of spreading them over a wide area to promote their frequent use among most casual players.

BTW, I agree that cheating offline is ok in (most) games, and duping is not done to hurt others (mostly.) Some restrictions may apply.
